terms and conditions

These terms and conditions apply and prevail in the case of any bookings made with me.

BOOKING & CANCELLATIONS

Workshops and events 

100% payment of the event fee is required at the time of booking. 

Bookings are non-refundable. If for any reason you can no longer attend, please inform me by email to ellajenniferyoga@gmail.com. Provided at least 24 hours notice is provided, you will receive the equivalent credit to use towards another workshop or event. 

Retreats 

At the time of booking, I require a non-refundable deposit of 30% of the total cost to be paid within 7 days of confirmation of a place on the retreat. If I do not receive the deposit within this time period, I cannot guarantee you a place on the retreat.​

A second payment of 30% of the total cost is due 12 weeks before the retreat start date.

A final payment of the remaining balance (40%) is due 6 weeks before the retreat start date. 

Alternative payment plans may be agreed on a case by case basis.​

I understand that sometimes, things happen which mean that you will need to cancel your booking. 

If for any reason you have to change or cancel your booking or event, please inform me as soon as possible by email to ellajenniferyoga@gmail.com.

My cancellation policy for retreats is as follows:

  • In all cases, the booking deposit is non-refundable and non-transferable.

  • If the cancellation is made more than 12 weeks before the retreat start date, 70% of the total cost is refundable.

  • If the cancellation is made between 12 and 6 weeks before the retreat start date, 40% of the total cost is refundable.

  • If the cancellation is made after the final payment is due, then the full payment will be forfeited, and if full payment has not yet been made, you will be liable for the total cost of the booking.

Once your booking has been confirmed, I will make every effort to provide you with the retreat you have booked for.

While I reserve the right to make adjustments to my offerings, in rare cases, it may be necessary to amend or cancel your booking in whole or in part. In that case, I will notify you of any alteration or cancellation as soon as I reasonably can.

EXTRAORDINARY SITUATIONS BEYOND MY CONTROL

In the event of extraordinary situations beyond my control, I reserve the right to change or cancel bookings and in that case, will inform you as soon as possible and communicate transparently about alternate arrangements. I do not accept responsibility for any costs incurred, including airfare.

Extraordinary circumstances beyond my control include war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics and pandemics, health risks, technical problems with transport including changes due to rescheduling or cancellation of flights by an airline or alteration of the airline or aircraft type, closed or congested airports or ports, hurricanes and other actual or potential severe weather conditions, theft and any other similar events.

TRAVEL INSURANCE​

It is your responsibility to ensure that you have adequate medical and holiday insurance.

Please ensure that you:

  • purchase travel insurance from the moment of your booking so you are protected in the unfortunate case of something arising before you travel, including any lost costs and flights; 

  • purchase full cover for flight cancellation, delay and curtailment, medical expenses and personal belongings, including valuables;

  • ensure your policy covers any sports, including yoga, you participate in during the retreat (please note some insurances do not automatically extend to these). 

Not having travel insurance cover is at your own risk, and I will not be liable to cover any costs or losses associated with travel cancellations or delays, sickness and injuries, or loss or damage to personal belongings. 

VISAS

For international retreats, it is your responsibility to check with the government of the destination country on which visa you will need to obtain to enter, depending on which country you will be travelling from. I will not be liable for any costs incurred or losses associated with visa delays or refusals. Please make sure you arrange in plenty of time.  

LIABILITY & INJURY

​It is your responsibility to communicate any injuries or restrictions I should be aware of before participating in any of my offerings or events. Ahead of my events, I will request this information from you and will ask you to sign a liability waiver stating that you understand that yoga is not a substitute for medical attention, examination, diagnosis, or treatment; you should consult a physician prior to beginning any activity program, including yoga; you recognize that it is your responsibility to notify the teacher(s) of any serious illness or injury, or pregnancy, before every yoga class; and you will not perform any postures to the extent of strain or pain. 

PHOTOGRAPHY & VIDEOGRAPHY 

​I sometimes have a photographer in attendance at my events, whose job it is to capture still images and videos for use in my public communications (including social media, website, email newsletters, etc.). 

Ahead of my events, I will inform you if a photographer will be in attendance and will provide you the opportunity to opt out if you do not wish to be included in any photographs or videos of the event.

LIMITATION OF LIABILITY 

This condition sets out my entire financial liability (including any liability for the acts or omissions of our employees, teachers, consultants and suppliers) to you in respect of: (a) any breach of contract; (b) any use made by you of the retreat or the services I provide to or arrange for you; and (c) any representation, statement or tortious act or omission (including negligence) arising under or in connection with our contract or the retreat. 

  • All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from our contract.

  • Nothing in these conditions limits or excludes my liability: (a) for death or personal injury resulting from negligence; or (b) for any damage or liability incurred by you as a result of our fraud or fraudulent misrepresentation. 

  • My total liability to you in relation to you in tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with our contract and the retreat shall be limited to the price you pay to us.
